TERMS AND CONDITIONS
FOR THE SUPPLY OF THE MORAY COUNCIL PRODUCTS AND SERVICES THROUGH ITS WEB SITE

1. YOUR STATUTORY RIGHTS

None of these terms and conditions in any way affect your statutory rights.

2. THE CONTRACT BETWEEN US

The Moray Council must receive payment of the whole of the price for the goods that you order before your order can be accepted through this web site. The Moray Council's acceptance of your order by email confirming it has shipped your product brings into existence a legally binding contract between us. That acceptance will be deemed to be complete and will be deemed for all purposes to have been communicated to you at the time The Moray Council sends the email to you (whether you receive it or not).

3. PRICE

Before the contract is concluded:-

1. The prices payable for goods and services that you order including any taxes will be as set out in our order confirmation page.
2. You will be required to pay extra for delivery and this will be calculated during the order process. Please note it is not possible for us to deliver to some locations.

4. CUSTOMS AND IMPORT DUTIES

If your live outside the UK you may be required to pay additional customs or import duties when goods enter your country.

5. AVAILABILITY OF GOODS YOU ORDER

If The Moray Council has insufficient stock to deliver the goods ordered by you, any sum debited by The Moray Council from your credit card will be re-credited to your account and The Moray Council will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order.

6. DELIVERY OF GOODS TO YOU

1. The Moray Council will deliver the goods ordered by you to the address you give The Moray Council for delivery at the time you make your order.
2. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you (unless you cancel the contract). Risk of damage or loss of the goods shall pass to you on delivery.
3. Delivery may take up to 28 days after your card is debited.

7. LIABILITY

7.1 Where

1. The goods The Moray Council delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity.
2. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, The Moray Council shall have no liability to you unless you notify us at our address of the problem within 40 days of the date on which you ordered the goods.

7.2 The Moray Council's only obligation will be, at its option

1. to make good any shortage or non-delivery
2. to replace or repair any goods that are damaged or defective; or
3. to refund to you the amount paid by you for the goods in question.
Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit The Moray Council's liability to you for any death or personal injury resulting from its negligence.

8. YOUR RIGHT TO CANCEL

1. If for any reason you are unhappy with the goods dispatched to you, you can send a notice of cancellation to The Moray Council at our address within 7 days after the date of dipsatch and the contract between us will be treated as if it had not been made.
2.  You will pay the costs of returning the goods to The Moray Council at our address by the same method as they were delivered in the event that the goods had been dispatched by The Moray Council prior to receipt of the written notice of cancellation.
3. On cancellation and return of the goods, The Moray Council will refund your payment as soon as possible and, in any event, within 30 days of receipt of the written notice of cancellation.

10. FORCE MAJEURE

The Moray Council shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

11. INVALIDITY

If any part of these conditions is unenforceable (including any provision in which The Moray Council excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

12. ENTIRE AGREEMENT

These terms and conditions, together with the current The Moray Council Web site prices, delivery details and The Moray Council contact details, set out the whole of our agreement relating to the supply of the goods to you by The Moray Council.
